Terms of Use:
Interpretation:
In this document: words denoting the singular include the plural and vice versa; references to “he/she” include “they” and “it” as appropriate; “Person” means an individual, a collection of individuals or a company; “Material” means text, photographs, logos and any other elements submitted to the site which relate to the content, design or layout of any advertisement.
Parties:
Acceptance of these terms, which is indicated by registration with this site, creates a binding contract between:
The person who registers to advertise on this site (the advertiser) and
Paul Hughes trading as Direct Property Rentals (the Provider).
The Provider is in no way party to or bound by any contract between the Advertiser and any person agreeing to rent the advertised property.
Rights and Responsibilities:
The Advertiser:
By registering with the site, the advertiser represents that to the best of his/her knowledge and belief:
Ø The description given of the advertised property is true and accurate at the time of submission;
Ø Any other details submitted are true and accurate at the time of submission;
Ø The Advertiser is entitled in law to advertise the property for let;
Ø Nothing in any material submitted violates any intellectual or other property right of any other person, in particular
- Nothing in any such material amounts to any breach of rights relating to branding;
Ø The advertisement includes no false or misleading information;
Ø Nothing in any element of the advertisement as submitted violates any UK law.
The Advertiser agrees to inform the site as soon as possible of any change of circumstances which affect his/her knowledge or belief on any of the above points or which might otherwise affect this agreement.
Payment:
Payment is due upon before any advertisement is placed on the site. If for any reason payment becomes overdue, the Provider reserves the right to claim late payment compensation, including reasonable costs of recovery. In the event of any payment or part-payment becoming overdue, the Provider further reserves the right immediately to:
Ø remove any advertisement submitted by the Advertiser and published on the site;
Ø reject any advertisement submitted by the Advertiser but not yet published.
Advertisers must subscribe to twelve months rental before any access to other services on the site, such as Late Availability, Property Of The Month and Recomended Properties feature.
Any special offer is on a once only basis and is not available to repeat registrations of the same property or to more than one property on the same site.
Conduct:
The Advertiser agrees to comply with these terms and otherwise to conduct him/herself in an acceptable manner in all his/her dealings with the Provider. He/she accepts that any failure to do this is likely to result in:
Ø the immediate removal of any advertisement submitted by him/her and published on the site;
Ø the rejection of any advertisement submitted by him/her to the site and not yet published.
in either event, no refund is available.
Indemnity:
The Advertiser agrees to indemnify the Provider to the fullest extent against any loss or damage, however resulting from any advertisement submitted to and/or published on the site.
The Provider:

Accuracy:
The Provider will take all reasonable care to ensure that details submitted by the Advertiser are accurately reproduced in the published advertisement. However, it can accept no liability for any loss or damage, however resulting from any error or omission.
Time-scales:
The Provider aims to approve and publish advertisements as soon as possible after submission. However, no guarantees as to time-scales can be given.
The Publication Process:
Design, Content and Layout:
The Provider will determine the final design, layout and content of the advertisement and may therefore make minor alterations to the material submitted by the Advertiser. If major alterations are needed, the material will be returned to the Advertiser. All material submitted by the Advertiser will be returned once the advertisement is ready for publication.
Submission and Return of Material:
Material may be submitted and returned by email.
Alternatively, it may be submitted and returned by post. In that event, the Advertiser is strongly advised to use Royal Mail’s Recorded or Special Delivery services, or to use courier services, when transferring material between him/herself and the Provider. Returns by standard post are at the Provider’s expense. Other methods of posting, including courier services, are at the Advertiser’s expense.
Quality:
The site reserves the right to reject any material submitted by the advertiser which does not meet its quality standards relating to text, photographs, images or otherwise.
Advertising Options:
Substitution of Properties:
The advertiser may substitute one property for another during the life of his/her subscription to the site. These terms apply to the submission of substitute properties as they do to the submission of the original advertised property.
The Provider reserves the right to reject any proposed substitution.
Upon acceptance of a substitute property, the original advertised property will be removed from the database.
Please contact the Provider before submitting details of any proposed substitution.
Multiple Properties:
The Advertiser may advertise more than one property, sharing facilities on the same property site, by the use of a multiple property advertisement. Please see the list of charges and contact the Provider before submitting any details of multiple properties.
This agreement applies to multiple property advertisements as it does to single property advertisements.
Continuity of Service:
The Provider takes all reasonable care to ensure continuous availability of its services via the internet. However, no guarantees can be given as to website availability and the Provider can accept no liability for any interruptions to service which are beyond its reasonable control.
Updates and Improvements:
In order to maximize the benefits of using these services, it may be necessary from time to time to carry out work to update and improve the site. If and when such work is necessary, every effort will be made to ensure continuity of service. However, the Provider can give no guarantees on this point.
Force Majeur:
In any event the Provider can accept no liability for any loss or damage however resulting from: Any fire, flood, industrial dispute, military action, paramilitary action, act of government, act of war or act of nature, or any other event or circumstance beyond its reasonable control.
Term and Termination:
This agreement is for one calendar year from the date of registration. It will terminate automatically at the end of that period. The Provider reserves the right to terminate before the end of one calendar year if the Advertiser commits a material breach of this agreement which is not capable of remedy. This includes (but is not exclusive to) where the Advertiser knowingly or recklessly submits any material to the site which violates any UK law.

Damages:
Any damages payable by the Provider to the advertiser are limited to the fees paid by the advertiser to the Provider.
Amendment:
The Provider reserves the right to amend these terms at any time.
Construction, Governing Law and Jurisdiction:
This agreement is construed in accordance with and governed by the law of England and Wales and is subject to the jurisdiction of the English courts.
Severance:
If any part of this agreement is found by any court of competent jurisdiction to be illegal or unenforceable, the illegal or unenforceable part shall be severed and the remainder shall continue in full force and effect, as though the illegal or unenforceable part had never been enacted.
Data Protection:
The Provider processes all personal data received in accordance with the Data Protection Act 1998 (as applied in the UK). To this end, all data are processed in line with the Data Protection Policy – available from the Provider. The Provider cannot accept liability for processing outside this remit, be it by the Advertiser or any third party.
